Terms of Service

These Terms of Service (“Terms”) govern your use of Kourier.sh (“Service”), operated by Kourier AI Inc, a Texas corporation. By accessing or using our AI inference endpoint and Cloud dashboard at app.kourier.sh, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, using our API, or accessing our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. If you use the Service for an organization, you must have authority to bind that organization. You must be at least 16 and legally able to enter into this agreement.

2. Service Description

Kourier.sh provides open-weight AI model inference through an OpenAI-compatible API endpoint. Available models and plan features are described on our website and in the documentation. Access is subject to the concurrency limits and other technical limits of your plan, not a guarantee of unlimited simultaneous requests or a particular generation speed.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. API keys may be used only by you or your organization for its own use, including authorized personnel and agents acting on its behalf. Do not share API keys outside your organization or sell or resell them.

4. Acceptable Use

Automated workloads and agents are welcome. Flat-rate plans provide access to shared capacity for agentic coding, not dedicated capacity. You must not sustain usage that monopolizes shared capacity and materially degrades service for other users, even if individual requests stay within your plan’s technical limits. To protect shared capacity, we may queue or throttle requests, or suspend access.

Reselling, sublicensing, or providing the Service to third parties through a proxy requires a separate written agreement with Kourier. This restriction concerns access to the Service, not your rights in generated outputs or rights granted by applicable model licenses.

You may not use the Service for bulk dataset generation or model distillation.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt unauthorized access to our systems, extract credentials, or bypass security and access controls. Nothing in these Terms restricts rights granted by applicable open-source or model licenses
• Use the Service to violate any applicable laws or regulations
• Circumvent the concurrency limits or other applicable technical limits of your plan
• Use the Service in a way that could disrupt or interfere with other users

5. Payment and Subscriptions

Paid subscriptions renew automatically at the billing interval and price shown at checkout unless canceled. Dodo Payments handles checkout and subscription billing. Review the total, currency, and any applicable taxes shown before confirming your purchase.

You can cancel renewal from the billing dashboard. Cancellation is scheduled for the end of the current billing period, with access continuing through that period. If the dashboard does not allow cancellation, including when payment is past due, contact support@kourier.sh for assistance. Canceling renewal is separate from deleting your account or requesting a refund.

Plan changes are processed with immediate proration through our billing provider; review the displayed adjustment before confirming. Failed payments may interrupt access. Contact support@kourier.sh for refund requests or billing disputes. Cancellation does not by itself issue a refund; nothing in these Terms limits refund, withdrawal, or other consumer rights required by applicable law. We will give reasonable notice of subscription-price changes.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided “as is” and may be temporarily unavailable for maintenance, updates, or other reasons. We will communicate scheduled maintenance in advance when possible.

7. Content and Intellectual Property

You retain your rights in the prompts, code, files, and other content you submit. You authorize us to process and transmit that content only to provide the Service, subject to the data practices described in our Data use & retention policy and any applicable signed DPA. We do not use your prompts or generated outputs to train or fine-tune models.

As between you and Kourier, we do not claim ownership of your generated outputs. This does not guarantee that output is copyrightable, unique, accurate, secure, or free of third-party rights. You are responsible for having the rights and permissions to submit content and for reviewing outputs before using them, including code before running or deploying it. AI output is not a substitute for qualified professional advice.

The Service software and infrastructure remain the property of Kourier AI Inc or its licensors. Applicable open-source and model licenses continue to govern the rights they grant.

8. Limitation of Liability

To the maximum extent permitted by law, Kourier AI Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service for conduct that we reasonably believe violates these Terms or materially harms other users, us, or third parties. Where practicable, we will explain the concern and give you an opportunity to respond before suspending access; urgent security or capacity protection may require action first. Contact support@kourier.sh to ask for review of a restriction. Mandatory consumer rights are not limited by this section.

10. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after such modifications constitutes your acceptance of the new Terms.

Our Privacy Policy explains personal-data processing. Businesses can contact legal@kourier.sh to discuss a Data Processing Addendum. A DPA applies only when separately agreed and executed; it takes precedence for the processing it covers in the event of a conflict with these Terms. Mandatory transfer clauses and statutory rights are not limited by these Terms.
